Starting in September 2023, Canada’s Recognized Employer Pilot (REP) introduces key improvements to the Temporary Foreign Worker Program (TFWP), designed to streamline the hiring process:

  • Extended LMIA Duration: Employers can now secure a Labour Market Impact Assessment (LMIA) that is valid for up to 36 months.

  • Enhanced Application Process: A more straightforward application experience is available through the new Online Portal.

Eligible Occupations for Recognized Employer Pilot Program

  • Phase 1 (September 2023): Initially includes five designated job roles.

  • Phase 2 (January 2024): Expand to cover additional job categories.

Eligibility Requirements for Recognized Employer Pilot Program

Employers who are looking to participate in the REP must:

  • Have achieved three positive LMIA outcomes within the last five years.

  • Uphold high standards of working conditions and comply with TFWP regulations.

Employer Responsibilities

To qualify for the REP, employers need to:

  • No Recruitment Fees: Ensure that Temporary Foreign Workers (TFWs) are not charged any recruitment fees.

  • Verify Business and Job Offer: Provide proof of the authenticity of their business and job offers.

  • Prioritize Canadian Workers: Focus on hiring Canadian citizens and permanent residents before considering TFWs.

  • Health Insurance: Offer private health insurance if necessary.

  • Ensure Safety: Maintain a safe work environment and provide proper employment contracts.

Fees

  • Processing Fee: A non-refundable fee of $1,000 per position applies.

Penalties for Non-Compliance

Failure to comply with REP guidelines can lead to:

  • A two-year exclusion from the TFWP.

  • Public disclosure of non-compliance.

  • Potential suspension of LMIA approvals.
