Lately, Justin Trudeau had unveiled the federal government’s priorities in a compulsory letter written to immigration minister on Dec 16. In this letter, he has shared the new priorities for the immigration system of Canada. What all they are looking for in a candidate and how to shorten the processing time of the same. The priorities state that Canada should decrease the processing time for immigration applications and concentrate  on expanding permanent residency opportunities for the international students.  Prime Minister Justin Trudeau has shared the same in a letter to Canada’s new immigration minister Sean Fraser.

Trudeau also laid out the federal government’s priorities in This mandate letter written to Fraser on December 16. Fraser had recently started office as the Minister of Immigration, Refugees and Citizenship of Trudeau’s cabinet on October 26.

Further in this letter, Trudeau has focused on the 13 measures that the immigration department should focus on. In his letter, Trudeau has also asked the immigration minister to continue the policies in place to give a push to the integration of immigrants in the French-majority province of Quebec by “complementing existing measures, and continue to implement an ambitious national strategy to support Francophone immigration across the country”. With the support of the Minister of Foreign Affairs, they will continue with the safe passage and resettlement of vulnerable people from Afghanistan, along with an emphasis on individuals who supported Canada and our allies over the past two decades, women, LGBTQ2 people, human rights defenders, journalists and members of religious and ethnic minorities and increase the number of eligible refugees from 20,000 to at least 40,000.
  4. They will work to reduce the application processing times, including to address delays that have been impacted by Covid-19.
  5. They will also work to strengthen family reunification by introducing electronic applications for family reunification and implementing a program to issue temporary resident status to spouses and children abroad while they wait for the processing of their permanent residency application.
  6. Work for the citizenship application process free for permanent residents who have fulfilled the requirements needed to obtain it.
  7. With the help of Minister of Employment, Workforce Development and Disability Inclusion, establish a Trusted Employer system for Canadian companies hiring temporary foreign workers and, as part of improving the Global Talent Stream of the Temporary Foreign Worker Program, simplify permit renewals, uphold the two-week processing time and establish an employer hotline.
  8. They will work to build on existing pilot programs to further explore ways of regularising status for undocumented workers.
  9. They aim to continue working with Quebec to support the French-language knowledge of immigrants in Quebec.
  10. They will lead the government’s work on irregular migration, including continued work with the United States to modernise the Safe Third Country Agreement.
  11. The government will also work to expand pathways to Permanent Residence for international students and temporary foreign workers through the Express Entry system. This is in respect to pathways for agricultural temporary foreign workers, you will be supported in this work by the Minister of Agriculture and Agri-Food.
  12. They will work on building on the Economic Mobility Pathways Pilot, work with employers and communities across Canada to welcome 2,000 skilled refugees to fill labour shortages in high-demand sectors such as health care.
  1. They are also focused to ensure that immigration better supports small- and medium-size communities that require additional immigrants to enhance their economic growth and social vibrancy. The main consideration is it cannot be seasonal work, and has to be continued for at least one year after you get your permanent resident visa. Another important criteria is that it also has to be in a skilled occupation category. This means it should fall under the categories 00, 0, A, or B on the National Occupational Classification (NOC) system.

The points will only be awarded to you when your employer needs to get what is called a positive Labour Market Impact Assessment (LMIA). An LMIA is a document that the employers are often in need to hire a foreign worker. It also states that that there will not be any negative impacts on the Canadian job market if the company hires a foreign worker. Although, there are few occupations that are exempted from this producing this document.

One can also claim the job offer points for the exempted occupations as well. The condition states that the worker has to work for the employer for a year and then will continue to work for them for at least one year after they get their permanent resident visa. The current employer also has to be the one specified on your work permit.

Further, the new IRCC data reveals how the immigration department is prioritizing Express Entry applications. The data shows the number of permanent residence applications submitted in the category of Express Entry that have been approved by Immigration, Refugees and Citizenship Canada are based on some specific criteria. 

As it is quite evident that the Express Entry is the important source of earning a permanent residency in Canada. They create a space for economic class skilled immigrants through this particular category. Candidates who meet the criteria of an Express Entry program are welcome to submit their profile on IRCC’s website.

After submitting the application, the candidates get assessed through Comprehensive Ranking System (CRS) scores based on various factors including human capital criteria such as their age, education, language skills, and work experience.All this assessment and process takes some time.

Then approximately every two weeks, there is the next express entry draw and the IRCC invites the highest scoring candidates to apply for permanent residence. Once selected, the candidate then has 60 days to submit their permanent residence application to IRCC.

Then they wait for approval. If after all the checks the IRCC approves the application, then the candidate receives a Confirmation of Permanent Residence (COPR) which ensures them to officially land in Canada as a permanent residence. If the applicant is already residing in Canada as a temporary resident then it refers to converting their legal status to permanent residence. 

Changes in IRCC policies-

Due to the pandemic conditions IRCC has made important changes in the Express Entry policies. For now the department is currently planning to finalise 401,000 new permanent residents by the end of this year. From the start of this year, they made the decision to focus on finalising more temporary residents to permanent residence and hence it will help the government in achieving its 401,000 immigrant target.

Hence, to work on this policy the immigration authorities are only inviting Canadian Experience Class (CEC) and Provincial Nominee Program (PNP) candidates under Express Entry this year. 

Well, this comes as a major change as the Federal Skilled Worker Program (FSWP) accounted for almost 45 percent of successful Express Entry candidates before the pandemic. IRCC has shifted its policy on a temporary basis for two reasons.

First, it states that almost 90 percent of CEC candidates are residing in Canada during the pandemic, so they are less likely to face COVID-related disruptions and it means they can complete their permanent residence landings in the year 2021 itself. Secondly, IRCC will continue to invite PNP candidates to help provinces across the country address to fulfill their labour market needs.

Now, there is a big visible change. Due to this policy IRCC has not been inviting the highest-ranking candidates among the entire Express Entry pool, rather it has invited the highest-ranking CEC and PNP candidates. It means the authorities are choosing applicants within the country. This has further caused the overall CRS cut-off scores to decline. The IRRC department aimed to invite as many CEC candidates to complete it’s immigration target for this year. 

As per the reports, IRCC is showing that the CEC is accounting for some 85 percent of all finalized Express Entry applications this year. As per the statistics, between January and October, IRCC issued COPRs to 108,860 CEC applicants. The department has issued 12,514 COPRs to PNP candidates.

Initially the IRCC got off to a slow and steady start to the year and finalized between 7,000 and 10,000 Express Entry applications per month till May. In June, it doubled, and IRCC has maintained a high pace of Express Entry application processing in the second half of this year.

At the end of the year, CEC candidates are the greatest beneficiaries of the increased processing capacity. IRCC has also increased the number of PNP applications it is finalizing but it still is not at the same level it processed. Further the data suggests IRCC has diverted their resources to process CEC applications as it can as it seeks to fulfil its 401,000 newcomer goal.

Further the reports state that the IRCC indicates a backlog of 1.8 million permanent and temporary residence applications. This includes just under 100,000 Express Entry applications as on October 27. If the IRCC follows its current pace, then it will process some 48,000 CEC applications remaining by January 2022. The next express entry draw is scheduled to be on 8th December 2021. It will further clear the immigration picture of the country.  

Canada shares good news- Extends online study eligibility period for PGWP applicants

Earlier, online study was not normally eligible for the Post-Graduation Work Permit (PGWP), but it has changed since the pandemic conditions. It has been allowed since then. 

As per this new rule, International students can now complete their studies online even from outside Canada, and then still get a PGWP once the program is successfully completed. Canada has extended the period that international students can study online until August 31, 2022, up from December 31, 2021.

This particular measure was initially implemented in the year 2020, as part of a coronavirus-related measure that allows international students affected by the pandemic to still be eligible for the PGWP.

The Canadian government website shares that the rule applies even if you are completing two study programs. This is applicable as the programs are continued or started between March 2020 and summer 2022.

The condition also states that these study programs must be with an eligible Designated Learning Institution and meet other PGWP requirements. The shortest length of a program can be eight months. It also states that the time spent studying outside Canada after August 31, 2022, and any time spent studying before you applied for a study permit does not count while calculating  the actual length of a PGWP.

Also, the length of your study period is important for the PGWP eligibility, and also in determining the validity of PGWP. If your study program is more than eight months but less than two years, the PGWP’s validity matches the length of the study program. If it is more than two years, then you are eligible for PGWP may be up to three years in duration.

Recently, Canada has held five Express Entry draws in a row to target a good number of candidates from the PNP class. The new express entry draw date was held on November 10. During this draw Canada invited 775 Express Entry candidates to apply for permanent residence. All of the invited candidates had already received nominations through a Provincial Nominee Program (PNP).

As per the immigration system the provincial nominees on their own get a 600-point award, so the cut off score came to be 685. It means without any nomination, the lowest-score would have had only 85 points. This is one of the utterly lowest scores till now. It is the second lowest since the lowest was in March 2021. It is evident that this is a clear effect of the pandemic on the immigration system of the country.

Currently, Immigration, Refugees and Citizenship Canada (IRCC) are drawing only PNP candidates from the Express Entry pool. As per the previous draw, IRCC invited a good number of 888 candidates with a cut off of 744.

Why is Canada only drawing on the PNP applicants?

It has been evident since the pandemic, IRCC has only been focusing on offering the immigrants who are already settled in the country. As during the pandemic situation the Canadian government sealed the borders, so, it is easy to verify and access the people who are staying in the country. Also, the entries have been closed for the people who were initially approved for permanent residence from but they are outside Canada.

As per the current restrictions there is no approval on the permanent residents from making their arrival persisted during the time period between March 2020 and June 2021. In this time period, the IRCC worked on the Express Entry draws that invited the PNP and Canadian Experience Class (CEC) candidates. In the year 2020, the special all-program draws were conducted. It  included Foreign Skilled Worker Program (FSWP) candidates and Foreign Skilled Trades Program (FSTP) candidates.

For the last five Express Entry draws, IRCC has particularly invited the PNP candidates to apply under the programmes of permanent residence. If the IRCC would not have taken keen interest in these candidates, it would have been a problem for the provinces and territories. They would not have been able to meet the immigration goals, which  generally were completed on time. This will hereafter affect the economic and population growth strategies of the country adversely. It will affect the economic growth of the country, they will not be able to meet the goals. 

In the previous summer months, IRCC worked up the CEC draws, inviting the big-breaking numbers of 6,000 at one time that helped to  meet the immigration department. It revised their plans to admit around 141,000 CEC candidates in 2021. The invitations were issued to them after July and it would be processed before the end of the year. The new express entry draw date has still to be shared by the authorities. The aspirants are waiting eagerly for it.
