There are several changes in the different immigration processes and a big change is on the go for those who are waiting for spouse sponsorship. If you are married or in a common-law partnership with a Canadian, here is the detailed information about the spousal sponsorship process. This information will help those applicants whose spouses are eager to sponsor their spouses in India.

Currently, Spousal sponsorship is a priority for Canada. Under the Immigration Levels Plan for the year 2022-2024, the government is working to call some 80,000 new immigrants from its Spousal, Partner, and Children category. Most of these immigrants will arrive as the spouses and partners of Canadians who are already settled and working here and waiting for their family to get united.

Originally, the process for spousal sponsorship applications and its treatment is almost one year. After the pandemic there has been huge delays Immigration Minister Sean Fraser also viewed this and  said that IRCC is once again able to process new spousal applications in 12 months. Canada has also launched a tracker application for spousal sponsorship applicants that helps them to monitor their application status. This step will help the applicants to review their status and plan accordingly.

So, if your spouse, common-law partner is a Canadian citizen or permanent resident, then here is how they can sponsor you for Canadian immigration. There are a new set of rules to speed up the process.

Canada’s spousal sponsorship process-

To get sponsorship, it is mandatory that you and your partner will have to meet eligibility criteria. You will have to prove that you are in an ongoing genuine relationship with your partner, and you are not in a relationship with them for the purpose of getting Canadian permanent residency.

Another thing, it is not necessary that Spouses or the common-law partners do not necessarily have to be in Canada to be sponsored. Canadian citizens can apply to sponsor from abroad as long as they are able to prove the said things to IRCC that they will live in Canada. The most important point is that only Permanent residents sponsor their spouses from Canada, even if their partner is living abroad. For better information and guidance the applicants can consult some experienced Canada Visa services.

Eligibility criteria for your Canadian partner-

Canadian citizens and permanent residents may be eligible to sponsor if they are at least 18 years old, if they are a Canadian citizen or permanent resident, or they are an Indigenous person registered under the Canadian Indian Act, they can prove that they are not receiving social assistance unless they have a disability and also they can provide for the financial needs of the sponsored person. If a person fulfils all the above conditions then they are eligible to sponsor.

Eligibility criteria for you as the person being sponsored-

For sponsorship the relationship should fall under the given categories

Common-Law Partners-

Conjugal Partner-

Then you must be at least 18 years old to be sponsored under any of these categories.

Along with this you must pass a health, security, and criminality screening and therefore be considered admissible to Canada.

How to apply for spousal sponsorship-

As you have established that you and your partner are eligible for sponsorship, you can then get IRCC’s application package on the government web page. Pay the necessary fees on IRCC’s website. It includes a processing fee, a right of permanent residence fee, and a biometrics fee. You have to submit two applications together at the same time: a sponsorship application and a permanent residence application.

After IRCC approves the application-

As you get permanent residency, you and your partner still have to fulfil some of the conditions of spousal sponsorship. Your Canadian partner should be still financially responsible for you for three years.

So if you ask the government for any kind of financial assistance at that time, then your partner may be forced to repay the government. You as the sponsored person may not sponsor another partner for five years after having been sponsored.
