When applying for a Labour Market Impact Assessment (LMIA) in Canada, employers are generally required to advertise job openings to prove that no qualified Canadian workers are available. However, specific situations allow for exemptions from this requirement, making the LMIA process more straightforward.

When Can Employers Skip LMIA Advertising?

1. Quebec Facilitated Processing

Employers in Quebec can benefit from a streamlined LMIA process for certain occupations. The province updates its list of eligible positions annually, allowing employers to bypass the usual advertising steps for roles that are in high demand or hard to fill. Some of these positions may also qualify for the Global Talent Stream, further expediting the process.

2. Specialized Service Technicians

Some roles require unique expertise or proprietary knowledge, so advertising may not be necessary. This exemption is typically granted for short-term positions (lasting six months or less) where finding and training a Canadian worker isn't practical. Examples include technicians brought in to install or service specialized equipment.

3. Application Fee

It’s important to note that even if an advertising exemption applies, employers are still required to pay the $1,000 processing fee for the LMIA application.
