Ways to extend your temporary status in Canada

Immigration, Refugees and Citizenship Canada (IRCC) offers a number of options that help the temporary residents to stay in Canada, even when waiting on a decision for permanent residence, or temporary residence. Though, there are some people who are not aware about the changes.

The situation can be well-explained with a suitable instance- maintained status means temporary residents who apply for a new temporary status do not necessarily have to leave Canada if their documents expire before IRCC makes a decision. It is believed that by maintaining the previous status, such as students or visitors, or even as temporary foreign workers, one can stay in Canada on the given previous conditions as long as they hear back about their new application. There are many temporary residents who have already applied for the chance for permanent residency and are now dealing with the  situation of expiration or validity and hence may be able to get benefit from a Bridging Open Work Permit.

On the other hand few temporary residency permits are counted to be eligible for extension, under the programs including the Post-Graduation Work Permit that are not supposed to be renewed or extended. Now, this does not mean that these workers are not eligible for a different work permit. It can be checked through various ways and then they can reapply to extend their stay. 

Though there are many  options, it is not usually desirable for workers and students in Canada to apply for a Temporary Resident Visa (TRV), because it does not allow you to work or study. Those on a temporary basis can also create eligibility that lets them apply for a Visitor Record and therefore be allowed to stay more than six months.

But to be honest again they will be able to work or study in Canada. Again there may be other options to stay for people who are eligible but cannot apply for work permits, in particular cases. There are various options to prolong the stay, but one has to check how it is possible. 

Work Permits-

Canadian work permits are split into two main categories, those that require a positive or neutral Labour Market Impact Assessment (LIMA), and those that are LIMA exempt.

The LMIA shows the Canadian government that there is an actual requirement for a foreign worker and it is not for personal benefit. This means that the employer is in need of the worker,  so the employer will go through the LMIA process. Once the Employment and Development Services Canada have verified the situation and then issued a good report to the LMIA for the employer, then the  employer shares the worker a copy of the same confirming letter. After this, the worker then opts for a work permit to IRCC.

There are a number of work permit programs that help to confirm the LMIA processes and are able to build labour shortages. The work permit for the same has a processing standard of two weeks. 

Most of the people who are working as temporary foreign workers work on the basis of LMIA-exempt work permits. It is visible that in the year 2021 approximately, 315,000 LMIA-exempt work permits were issued by the authorities. It is almost three times more than the normal routine. 

The main purpose behind the step of  LMIA-exempt work permits  is to help the Canadian interests. Such work permits fall under the category “significant benefit”. This means though the worker is a foreign national, the genuine work will benefit Canada in all measurable ways. Be it the culture of the country or the economy.

Further,  the ‘Reciprocal employment’ means  when Canada has a pact with another country. They allow exchange of workers across borders. Under this the labour market is balanced since the foreign workers may have the same kind of  opportunities in Canada as Canadian workers may have in another country.

The LMIA-exempt category shares an open work permit that permits the holders to work any part of Canada with any employer in Canada.

Study Permit-

For those who want to get a study permit, they need to be first accepted to a Designated Learning Institution. Then the aspirant can use their letter of acceptance to further apply for a Canadian study permit. In a similar case if you are already in Canada then the applicant can work and learn together. Once the student has finished the program, then they may be eligible to stay in Canada after study.
